Recognized as one of the leading trial attorneys in New England, Clyde Bergstresser is a Fellow of the American College of Trial Lawyers and recognized by the Best Lawyers in America as 2014 and 2017 Lawyer of the Year for Medical Malpractice-Boston, and routinely listed as one of the top 10 or 100 Super Lawyers in Massachusetts. His verdicts and settlements have been among the highest in New England. Clyde represents plaintiffs in legal malpractice actions arising out of negligence in all phases of legal practice including corporate law, business law, personal injury actions, whistleblower actions and contracts. Clyde also represents plaintiffs in catastrophic personal injury litigation, including medical malpractice, psychiatric malpractice, premises liability, worksite injuries and wrongful death, among others. Clyde served as the prevailing trial and appellate counsel in Glicklich v. Spievack, 16 Mass.App.Ct 488 (1983), the seminal decision in Massachusetts addressing the issue of causation in cases involving “delayed diagnosis” of cancer. He has continued to represent patients and families in cases arising out of delayed diagnoses of a variety of types of cancer. Clyde was trial counsel in Rogers v. Okin, 478 F.Supp. 1342 (D.Mass. 1979), a landmark civil rights verdict after a 74-day trial establishing procedural safeguards for the use of medications on psychiatric inpatients. He has also represented many plaintiffs who have been the victim of sexual abuse by psychiatrists, psychotherapists, clergy and others.
Clyde has lectured for Massachusetts Continuing Legal Education (MCLE), Harvard Continuing Medical Education, the Massachusetts Bar Association and the Boston Bar Association. He has been frequently invited to give training lectures to trial lawyers and physicians.
Clyde’s undergraduate degree was in electrical engineering where he was selected to be President of Eta Kappa Nu (the Electrical and Computer Engineering honor Society).
