Elliot has practised intellectual property (IP) law on 4 Continents since 1995 – first in Australia, then Europe, and since 2005 in China. From Clyde & Co’s China offices Elliot now advises international clients on contentious and non-contentious IP matters, with a focus on strategic protection, exploitation, and enforcement of patents, trademarks, copyright as well as trade secrets. He advises on strategies for optimizing IP portfolios across the Asia Pacific region, as well as cross-border patent, trade mark and copyright disputes.

He represents a number of Fortune 500 companies and other MNCs on China IP litigation and especially Patent litigation.His expertise includes Intellectual Property (IP) protection & enforcement in China and in Asia-Pacific, especially IP and Patent Litigation and Cross-border IP Protection Strategies, IP Portfolio Optimisation and Monetisation Strategies.

Elliot is a Solicitor (England & Wales), an Attorney-at-Law (NY), and a Barrister & Solicitor (Vic), with B.Com. B.Ec.(Murdoch University, 1992) L.L.B. Honours (Monash University, 1994) B.C.L.,Honours (University of Oxford, 1998).

Experience: Elliot has managed a range of complex patent litigations, trademark and copyright litigations and successfully petitioned and litigated before the Supreme People’s Court (SPC) on numerous occasions. His recent briefs include: • winning the re-hearing before the SPC for one of Europe’s largest diversified steel and engineering companies in strategic patent litigation • enforcing for and defending a Fortune 500 high-tech company in relation to technologies ranging from adhesives and coatings to automotive applications, fibre-optics and medical devices • winning numerous patent infringement lawsuits for a global infrastructure engineering group in China and Asia-Pacific • winning patent and design infringement lawsuits for the world’s leading water filtration company and thereby defending its competitive advantage in China • developing a Chinese freedom-to-operate and IP strategy for one of Europe’s largest automotive parts suppliers, including IP mapping and competitor-threat analyses
